1. Overview / Agreement

These Terms & Conditions constitute the complete agreement between LAB.OTANICA Plant Magic, Meleesa Luna Enterprises, and HypnoSister.co (“we,” “us,” or “our”) and the retreat participant (“you” or “guest”).

By booking Desert Rose Retreat, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, including our cancellation policy, payment schedule, and limitation of liability.

2. Booking & Payments

A non-refundable deposit of $750 USD is required to secure your retreat spot.

The remaining balance must be paid in full no later than 45 days prior to the retreat start date.

Bookings made within 45 days of the retreat require full payment at the time of booking.

Payments may be made via approved payment methods or payment plan providers, including but not limited to credit card, Affirm, Klarna, Afterpay, or PayPal.

All payments, including deposits and installment payments, are non-refundable and non-transferable.

Failure to complete payments by the due date may result in forfeiture of your reservation.

3. Cancellation by Guest

All cancellation requests must be submitted in writing.

Because accommodations, meals, staffing, and retreat experiences are reserved specifically for each guest, all payments are strictly non-refundable and non-transferable, regardless of circumstance.

This includes but is not limited to:

  • Illness or injury
  • Family emergencies
  • Flight or travel delays
  • Weather disruptions
  • Personal scheduling conflicts
  • Force majeure events

We strongly recommend purchasing travel insurance, especially CFAR (Cancel For Any Reason) coverage, to protect your investment.

4. Cancellation by Organizer

We reserve the right to cancel, postpone, or modify the retreat due to unforeseen circumstances beyond our control.

These may include but are not limited to:

  • Natural disasters
  • Severe weather
  • Fire or flooding
  • Government restrictions
  • Venue cancellation
  • Public health emergencies
  • Travel disruptions

If we must cancel the retreat, your payment will be transferable to a future retreat within 18 months.

We are not responsible for incidental costs including:

  • Flights
  • Rental cars
  • Hotel stays
  • Personal travel expenses

No cash refunds will be provided unless otherwise required by law.

5. Travel Responsibility

You are solely responsible for arranging your transportation to and from Palm Springs, California.

This includes:

  • Flights
  • Rental cars
  • Rideshare
  • Parking arrangements
  • Any personal travel expenses

We may assist in coordinating rideshare between participants, but transportation remains your responsibility unless explicitly stated otherwise.

6. Health & Medical Responsibility

By attending, you confirm that you are physically, mentally, and emotionally able to participate in retreat activities.

Activities may include:

  • Hiking
  • Movement sessions
  • Breathwork
  • Sound healing
  • Pool / hot tub use
  • Other wellness experiences

Please notify us prior to booking of any injuries, medical conditions, allergies, or concerns that may affect participation.

You are responsible for consulting with your healthcare provider if needed.

7. Assumption of Risk & Liability Waiver

By attending this retreat, you acknowledge that participation involves inherent risks, including physical exertion, environmental exposure, travel-related risks, and unforeseen incidents.

You voluntarily assume full responsibility for all risks associated with participation.

To the fullest extent permitted by law, you release and hold harmless LAB.OTANICA Plant Magic, Meleesa Luna Enterprises, HypnoSister.co, retreat facilitators, staff, and partners from any claims, injuries, losses, damages, or liabilities arising from your participation, except where prohibited by law.

8. Safety, Conduct & Community Respect

We are committed to creating a safe, respectful, and supportive retreat environment.

By attending, you agree to:

  • Respect fellow guests
  • Respect facilitators and staff
  • Honor property rules
  • Participate responsibly
  • Communicate respectfully

We reserve the right to remove any participant who:

  • Creates unsafe conditions
  • Violates community agreements
  • Causes property damage
  • Disrupts the retreat experience

Removal will occur without refund.

9. Property Damage

Guests are responsible for any damage caused to retreat property, furnishings, or accommodations due to negligence, misuse, or intentional actions.

Any repair or replacement costs may be charged directly to the responsible guest.

Please treat the retreat home and shared spaces with care and respect.

10. Independent Third-Party Services

Some services may be provided by third-party vendors, including:

  • Accommodations
  • Food services
  • Transportation
  • Spa services
  • Excursions

While we work with trusted partners, we are not liable for the acts, omissions, delays, or service failures of third-party providers.

11. Photos, Video & Content Use

By attending, you consent to photographs and videos being taken during the retreat for marketing, promotional, educational, and social media purposes.

If you prefer not to appear in photos or video, you must notify us in writing before the retreat begins.

We will make reasonable efforts to honor your request.

12. Itinerary Changes

We reserve the right to modify:

  • Retreat schedule
  • Activities
  • Facilitators
  • Locations
  • Experiences

Changes may occur due to weather, safety concerns, availability, or circumstances beyond our control.

Such changes do not constitute grounds for refund.

13. Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of the State of California, United States.

If any provision is found unenforceable, the remaining provisions shall remain valid and enforceable.

14. Updates to Terms

We reserve the right to update these Terms & Conditions at any time.

The most current version will apply to all bookings.
